“The Public Prosecutor’s conclusions. He refers to the absolution of 12th July 1950 of the commander of the parachuting Division 'Hermann Goering' and of the "istigators, organizers and executors" of the slaughters of Civitella, Cornia and San Pancrazio, then to the reopening of the investigations following the recovery of the dossiers of the "Cupboard of Shame" in 1994. “The forensic test was performed on 09.05.2005. The forensic test must take a position with respect to Boettcher's phisical condition which could prevent him to appear at the trial. It also contains the biography of Boettcher, born on 28.03.1921 and resident in Ligusterweg. He does not go to give testimony since he suffers from 'loss of memory'.”

“Transcript of Josef Milde’s interrogation of 19.05.2005. The document reports the whole interrogation with a short synthesis of the facts happened in Civitella, Cornia and San Pancrazio on 29th June 1944. Milde declares he never fired a shot against the victims of the slaughters. He belonged to the musical band of the German army.”

“Testimony of Carlo Gentile, resident in Germany, historian, examined as advisor of the office of the Military Tribunal of La Spezia as he has deeply studied the slaughters of Civitella, Cornia and San Pancrazio. He declares to have received a charge in 2004 from the German judicial authority as an advisor as regards the facts of Civitella and Vallucciole. Gentile has investigated on the British documents and on the German ones of the Deutsche Dienstelle in Berlin that takes care of the documentation about the German soldiers in the second world war. The reconstruction of the facts according to the expert follows.”

He tells the facts of Civitella. The testimony of the colonel of the carabinieri Roberto d’Elia follows. He conducted investigations of judicial police within the procedure in progress against the two defendants.”
